Terms of Use – NinetyRise

Effective from: 1 November 2026

1. Who we are

NinetyRise is operated by Dávid Klieščik, Dolný Smokovec 12, 059 81 Dolný Smokovec, Slovakia, contact support@ninetyrise.com ("we"). By creating an account you agree to these terms and acknowledge the Privacy Policy.

2. Your account

- The app is for people aged 16 and over.
- You are responsible for the accuracy of your details and for keeping your password safe.
- You can delete your account at any time in the app; this permanently deletes your data.

3. Subscription and free trial

- The app is offered as a subscription (NinetyRise PRO). New users get a 7-day free trial.
- Unless you cancel at least 24 hours before the trial ends, the selected subscription starts automatically.
- Subscriptions renew automatically for the same period at the current price unless cancelled at least 24 hours before the end of the period.
- Payments are processed by Apple through your Apple ID. Manage or cancel in iPhone Settings → [your name] → Subscriptions. Deleting the app does not cancel the subscription.
- Prices are shown in the app and on the App Store before purchase and vary by country.
- Refunds are handled by Apple under its policies (reportaproblem.apple.com).
- Apple's Standard End User License Agreement also applies to App Store purchases.

4. What the app is not

- NinetyRise is a self-improvement tool. It is not a medical device and does not give medical, psychological, nutritional or financial advice. Consult a professional before changing your diet or exercise.
- Results depend on you; we do not promise any specific outcome.
- "AI coach" and "AI analysis" only prepare a message that you send to a third-party service (e.g. ChatGPT). We are not responsible for those services' answers.

5. Your content

Everything you enter or upload (habits, ideas, photos, etc.) remains yours. You only grant us the permission to store and process it as needed to provide the app. Do not upload content you have no rights to or that is unlawful.

6. Acceptable use

In particular, you may not bypass security or payments, interfere with our servers, scrape data, use the app for unlawful purposes, or copy and resell it.

7. Availability and changes

We keep improving the app and features may change. We aim for continuous availability but cannot guarantee it (e.g. during maintenance or provider outages). You can export your data at any time.

8. Liability

To the extent permitted by law we are not liable for indirect damages, lost profits or data loss caused by circumstances beyond our control. Consumer rights that cannot be limited by contract remain unaffected.

9. Termination

You may delete your account at any time. We may suspend or close an account for serious breaches of these terms and will tell you why.

10. Governing law and disputes

Slovak law applies. Consumers may also go to the competent court where they live and use alternative dispute resolution or the EU ODR platform (ec.europa.eu/consumers/odr). Mandatory consumer protection rules of your country of residence remain unaffected.

11. Changes to these terms

We will inform you of material changes in the app in advance. If you disagree, you can delete your account.
